This former singer turned A- list franchise actor has zero chance of winning his lawsuit.

It isn’t discrimination when someone is trying to buy something using your credit card and the store asks for identification.

Tyrese Gibson is suing Home Depot for $1 Million over alleged discrimination

In February, Tyrese Gibson, Eric Mora and Manuel Hernandez went to the store on Victory Boulevard, but Gibson had begun to be recognized by fans. Gibson instructed the two companions to use his credit card for the purchases while he headed to the car—a directive he asserts he communicated to the cashier.

However, the cashier declined to finalize the transaction, prompting Gibson to re-enter the store in an attempt to resolve the situation.

Unfortunately, matters escalated when, according to the lawsuit, the cashier offered no substantial justification apart from reiterating store policy and insisted on verifying identification. Additionally, the suit alleges that the manager declined to speak to the actor.

After a heated discussion with the cashier that Gibson was finally able to complete the transaction.

Gibson, as well as the two plaintiffs, believe that the incident and the actions of the cashier were racially motivated. Now they are seeking $1 million in damages — which the actor says is equivalent to the amount of money he’s spent at the store over the years — as well as punitive damages.

In response to the claims, a statement for Home Depot told The Post that they “valued the actor as a customer”

“Diversity and respect for all people are core to who we are, and we do not tolerate discrimination in any form,” the statement read. “We value Mr. Gibson as a customer, and in the months since this happened, we’ve reached out to him and his attorneys several times to try to resolve his concerns. We will continue to do so.”
