John Melendez (Stuttering John)

John Melendez, famously known as “Stuttering John” from The Howard Stern Show, has lost his legal battle against SiriusXM. The 2nd Circuit Court of Appeals upheld a previous ruling that dismissed his lawsuit, which claimed the network used his voice and name to promote Stern’s show without permission.

Melendez, who left The Howard Stern Show in 2004 after 15 years to join The Tonight Show With Jay Leno, filed the lawsuit in 2020. He argued that SiriusXM was airing old recordings featuring him on two Stern-dedicated channels without compensating him. However, the court ruled that SiriusXM did not violate copyright laws, as they were profiting from the archival content itself, not Melendez’s individual identity.

Stern, who moved his show to Sirius in 2006 under a $500 million contract, retained the rights to air old episodes, including those with Melendez. Despite the ruling, Melendez’s attorney, Michael Popok, maintained that his client had a strong case and deserved compensation for his years of work.
